Welcome to ELQUEEN. By accessing or using this website (elqueen.com) or placing an order, you agree to be bound by these Terms & Conditions and our Privacy Policy and Refund & Returns Policy. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your state of residence) to purchase from ELQUEEN. By placing an order you represent that you meet this requirement.

2. Account Information

You are responsible for the accuracy of the information you provide at checkout (name, email, shipping address, phone). We rely on this information to fulfill your order; we are not responsible for delays caused by incorrect or incomplete information.

3. Products, Pricing, and Availability

• All product descriptions, colors, and measurements are best-effort representations. Subtle variations in fabric tone may occur due to monitor calibration and the handcrafted nature of our pieces.
• Prices are listed in US dollars and are exclusive of any duties or taxes that may apply at your delivery destination. Where applicable, US sales tax is collected based on the shipping address.
• We reserve the right to correct pricing or product information errors at any time, including after an order has been placed but before it ships. If a correction affects your order, we’ll contact you for confirmation or full refund.
• Listings are limited to available stock. We do not back-order unless explicitly stated on the product page.

4. Orders & Payment

Placing an order is an offer to purchase. We accept the offer when we send a confirmation email and capture payment via PayPal. PayPal processes all card transactions; ELQUEEN does not store full payment card numbers on its servers.

We may decline or cancel an order at our discretion (e.g. suspected fraud, payment failure, out-of-stock). If we cancel after capture, we refund the full amount within 3–10 business days.

5. Shipping

Free worldwide shipping is included on every order. Estimated delivery is 12 business days from the date your order is shipped, subject to carrier delays, customs, and local events outside our control. Tracking is emailed when your order ships.

Title and risk of loss pass to you upon delivery by the carrier to the address you provided.

6. Returns & Refunds

See our Refund & Returns Policy, which is incorporated into these Terms by reference. In summary: a 7-day money-back guarantee from the date of delivery, on items returned in original condition.

7. Intellectual Property

All content on this site — the ELQUEEN name, logo, product names, photographs, copy, designs, and the visual identity of the maison — is owned by or licensed to ELQUEEN and protected by US and international copyright, trademark, and unfair-competition laws. You may not copy, reproduce, republish, or distribute any of it without prior written permission.

8. User Content

If you submit a review, photo, or other content, you grant ELQUEEN a worldwide, royalty-free, non-exclusive license to use, display, and distribute that content in connection with promoting the brand. You represent that you own or have the necessary rights to grant this license.

9. Acceptable Use

You agree not to misuse the site, including but not limited to: attempting to gain unauthorized access, scraping, reverse engineering, uploading malware, or interfering with another user’s experience.

10. Disclaimers

The site and all content are provided “as is” and “as available.” To the maximum extent allowed by law, ELQUEEN disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Some states do not allow this disclaimer; in those states the limit is the narrowest permitted.

11. Limitation of Liability

To the fullest extent permitted by law, ELQUEEN’s total liability for any claim arising from or related to your purchase will not exceed the amount you paid for the item giving rise to the claim. Neither party is liable for indirect, incidental, consequential, or punitive damages.

12. Indemnification

You agree to defend, indemnify, and hold ELQUEEN harmless from any claim or demand arising out of your breach of these Terms or your misuse of the site.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. You and ELQUEEN each waive any right to a jury trial.

Class actions are not permitted; disputes must be brought individually. Nothing in this section prevents either party from seeking injunctive relief to protect intellectual property.

14. Changes to Terms

We may update these Terms from time to time. The current version is always posted on this page with a “last updated” date. Continued use of the site after an update constitutes acceptance of the new Terms.
